< restatement. (40-70 million over 3 Q's >

Your assumption of 3 Q's may be erroneous. I spoke with Sandy (at S3) last week about how far back they're going. She doesn't know and I believe the press releases didn't definitively state a number of quarters. Could they go back multiple years? Could the "error" be worse than 40-70 million? I see no way that this fiasco could have been an accident. How could any competent and responsible CFO let this occur? My best to all who are still holding. I unloaded last week as I feel the stock will continue to be under pressure. Litigation costs will impact future EPS. Consider another case. ARSW sued a distributor of their software last year for withholding royalty payments and under reporting revenues. The other company counter sued. Now ARSW is incurring $300K per quarter ($1.2 million a year). They have 12 million shares outstanding. That amounts to 0.10 per share, which is significant (20%) to ARSW who made 0.50 last year. Sure, S3 has more outstanding shares meaning less impact on EPS but it will negatively impact numbers.
