ORDER

The judge Claude Hilton a US District Judge stated that a court has broad discretion to manage its dockets.

He concluded that a stay should not ordinarily be granted unless there is a substantial patentability issue raised in the inter partes reexamination proceeding. He noted that it is remote that the board of Patent Appeals and Interferences (BPAI) would change the reexamination findings.

He went on to give the example of NTP vs RIM and how it took 10 yrs. He concluded that the chances of the BPAI changing the reexamination is remote...
