It is law that a brokerage may not loan fully paid stock (that is type 1 on a stock record). Only the un-paid balance of margin account stock may be loaned a.k.a. hypothecated, etc. Market makers can short all they want..however the brokerage house covering their trades must make delivery of shorted shares by borrowing them from other brokers or long institution funds.
