716-851-7130 Interesting point. Call that number and ask them point blank if that is going to happen. That is one answer that can only be given by the person/persons making the decision. I'm sure DEC is hard at work making sure this permit is handled PROPERLY

That is pure conjecture and I heard nothing like that from anybody there. I think in reality this whole type of project was very new to the DEC and as they learned things they naturally questioned what regulations should/could apply and I think that evolved over time. I think there was a natural discussion that occurred among the DEC players themselves and there were a couple of different points of view and you could hear that based on who you talked to at any particular time. LTG and others uncovered what could be a new consensus among the players that will allow an issuance of an air permit while a sw permit is independently pursued. So imo there are no nefarious plots afoot, no government incompetence (in fact all the DEC players seemed to be genuinely interested in doing the right thing), or corporate conspiracy. It is a natural permitting process for a new concept. I know this lacks the drama of other theories but I think is rooted in the real world.

Perhaps you should do some DD on the DEC site and make a few phones calls? That's what i did and it didn't take long to figure out all JBII is going to need is a simple air permit.....
