Note the clause: If an inventor later files such a foreign or international application, it can lead to abandonment of the U.S. application unless the non-publication request is rescinded before 45 days after filing the foreign or international application. Thus, extreme caution is recommended before considering non-publication. This allows the patent to remain unpublished until the foreign applications are filed. The statement during the CC was that this would happen. They have top patent attorneys, so they must be comfortable following this path. Turpin was very guarded during the call and seems the most concerned about secrecy. His response regarding white papers was that there is no need to publicize any of the work that is on-going. The most revealing statements I heard were "Lockheed Martin" and the explanation of the optical limiter. They are developing the foundation for affordable optical computing and he doesn't want to tip their hand any more than he has to, even if it keeps the share price down.
