Several thoughts:

1) I would like to see EPA on a leash, but the Greens have been running anti-coal strategy through the coursts in parallel with the - currently frustrated - legislative efforts. They have laid quite a bit of groundwork which may take years to overcome.

2) Notice how this stuff always comes out when nobody is looking - as near a holiday. Last year Timmy Geithner wrote a blank check against the taxpayers' account to bail out Feddie/Frannie.
