What the Supremes did was say the EPA had the legal authority to make the call. With Lisa Jackson in charge of the EPA it became a done deal.

BTW - how does a refinery cut CO2 emissions if it does not burn coal - in a meaningful way. I assume modern plants monitor excess stack O2 to control efficiency already.
