there was enough evidence to CHARGE him with a felony...making death threats.... from what i read AZ allows a person to be held for 72 hours if they are under suspicion of being a threat or do harm to themselves or others... there was ample evidence for the political hack of a sheriff to get loughner in the system, which would have put him on the list of people who would not be able to purchase a firearm LEGALLY
