Just for the sake of discussion, lets just suppose that the secret catalyst actually performs as claimed then where does JBII stand trying to keep a billion dollar secret?

Is there anyone who has followed the whole JB catalyst story line that does not have some concerns that either someone else owns it (as it was admittedly found in someone else's archive) or at the very least that nobody can own it?

Who has fallen for the Pepsi trade secret comparison? Don't they know that food recipes can't be protected by patents so they have no choice but to use trade secrets? There are many very similar cola products so it is really the marketing that makes the difference not the secret sauce.

How long do you think JB can keep it a secret before someone sells it to a competitor? If it ends up not being patentable, could anyone who has had access to it use it or sell it without any concerns of legal implications? Reportedly Islechem "tweeked" it at the molecular level. Have any of the current or past employees, contractors, consultants or government workers ever had access to learn the basic ingredients used to make the catalyst? Is there any paper trail of what chemicals have been shipped to the plant where the catalyst is produced?

How can JBI expand rapidly and also protect their secret after it is actually proven to have such a huge value? Are they going to deliver it in armored cars to all the processor locations and then stand guard? If they take P2O marine into international waters will they need to be concerned about pirates stealing the precious secret? How much will they have to pay in wages to everyone who has potential access to the "billion dollar secret" to keep them loyal? Will they have trouble getting Wall Street to invest when they do not even own the key patents that give them the edge over bigger and better funded competitors?

They know longer even mention trying to patent the catalyst. The only mention is possibly patenting the machine process. Why did that change?

Our P2O processing machine technology is not patent protected.

The Company has not sought patent protection for its P2O processing technology. However, we intend to do so in the near future. A lack of patent protection could have a material adverse effect on our ability to gain a competitive advantage for our machines and may have a material adverse effect on our results of operations, especially on future sales or licensing of our machines.

Our future success is dependent upon our ability to protect our intellectual property.

The Company may not be able to protect unauthorized use of its intellectual property and take appropriate steps to enforce its rights. Although management does not believe that its services infringe on the intellectual rights of others, there is no assurance that the Company may not be the target of infringement or other claims. Such claims, even if not true, could result in significant legal and other associated costs and may be a distraction to management. We plan to rely on a combination of copyright, trade secret, trademark laws and non-disclosure and other contractual provisions to protect our proprietary rights. Because the policing of intellectual and intangible rights may be difficult and the ideas and other aspects underlying our business model may not in all cases be protectable under intellectual property laws, there can be no assurance that we can prevent competitors from marketing the same or similar products and services.
