Dwight, I'm not sure where you picked up that version of the statement by Decker; here's what the Reuters story reported as his statement:

"''We believe litigation of this sort is yet another unfortunate consequence of the delay in the deployment and approval of a global 56K modem standard,'' Decker added."

The word "delay" does appear there. Insofar as the lawsuit having to do with the ITU-T standard being delayed, it's the other way around: if there hadn't been a delay there would not have been any grounds for a lawsuit since a standard would render the 2 56K solutions moot - there'd only be the surviving one, the ITU-T standard.
