It is not a role the founders saw it having. There was a vacuum and the justices walked in and filled it.

In the opinion of some they are abusing this power. There is no check on their power to declare laws constitutional or not. And when opinion after opinion comes in at 4 to 5, their decision making criteria seem purely arbitrary.
