It is not possible to extrapolate from one state's property laws to another state's property laws.

Yep.. it varies from state to state.. But MERS was created to elevate itself above the laws of all 50 state laws without any apparent grounding in law.

Thus, even in Virginia, I wonder if the foreclosure can be considered legitimate if the origination is suspect.

Either way.. it's still a major issue until the appellate court makes a decision on whether to uphold, or over-rule the lower court's decision.
