We have to wonder what is Apple’s main focus here, is it for the user if their device is stolen, or more for them when one of their products gets jailbroken?

It's completely legal to jailbreak any phone. If Apple bricked anyone's iPhone for that they would be sued very quickly.

On the other hand.... did you know if you access a MS Exchange server email account on your iPhone for company email, even if you pay for the phone and the bill yourself, your company can brick your phone at will? They can also selectively disable some functions including the camera. Creepy.
