I think the odds are very high that you are a great arm-chair quarterback as are many of the pundits filling up the airwaves right now and that any such case will not be judged in such a facile manner -- Any serious claim will take years and years to litigate. Best design practices at the time would be gone over in detail. Operations would get an even closer look. It isn't near as simple as you think -- I know enough to know -- what I don't know. It wouldn't be as easy as you say.
