There are levels.
Licensing for a fee or giving it away free so that any manufacturer can use it, is one.
Open source it so that any manufacturer can have full access to and modify the framework API of the OS, is another.
Controlled Open source so that any manufacturer can modify the framework API in a controlled manner, is another.

I consider all of the above "open" within a different degree. Open means choice and all of the above provide choice within a different degree.

...and then you have the iPOS fascist prison... where you have NO CHOICE.
