It will be hard to attract quality people to the RCMP if we allow this poor Mounty to be railroaded.

Mountie in infamous Taser incident ordered to trial in motorcyclist's death

Cpl. Benjamin "Monty" Robinson is going to trial charged with obstructing justice in the traffic death of a motorcyclist.


An RCMP officer involved in an infamous Taser incident has been ordered to stand trial in B.C. Supreme Court on a charge of obstructing justice in an unrelated case.

Cpl. Benjamin "Monty" Robinson was charged after an October 2008 crash in Delta, B.C., that killed 21-year-old motorcyclist Orion Hutchinson.

Originally scheduled to last four days, a preliminary inquiry into the incident ended Tuesday after two days in B.C. provincial court in the Vancouver suburb of Surrey.

Robinson is accused of leaving the scene of the accident, which occurred around 10:30 p.m., and walking to his home a short distance away. Police claim he returned 10 minutes later, when he advised officers he had two beers at a party and two shots of vodka at home before returning to the scene.

The officer then gave breath samples. Robinson had his driver's licence suspended for 90 days and lost his attempt to overturn the suspension in March 2009.

The British Columbia Criminal Justice Branch found that after a "comprehensive police investigation" there was not enough evidence to charge Robinson with impaired driving in December 2009.

There is a publication ban on all evidence presented at the preliminary inquiry.

Robinson was off duty when his Jeep collided with Hutchinson's motorcycle at an intersection.

A coroner's report stated Hutchinson had been drinking before the crash as well.

Robinson was also one of four officers involved in the October 2007 Tasering of Polish immigrant Robert Dziekanski at Vancouver International Airport. He was the officer in charge the night the 40-year-old died handcuffed and face down on the airport floor. The death, which was captured on cellphone video by a bystander, prompted outrage and a massive inquiry that recommended the officers be investigated. None of the Mounties have been charged in that case.

Robinson is suspended from work with pay. He returns to court May 19.
