It is the way the term is used in the legal system. Now, you can say the lawyers use the term wrong. After all, Brumar thinks that biologists use the term "species" wrong. Granted, it seems pretty unhinged, but there you go. "I don't think the "material" requirement of perjury can be made invalid after the fact" Huh? "I'm not a law expert" I am not either. So I tend to rely on judges, who presumably are.
