There is do doubt that there is no way to mine any of the region economically without the hard rock rights. That includes GLR, Placer Dome/Crystallex and all surrounding areas. If the courts stop the hard rock rights then there will be no mines - it's as simple as that. I think what we are seeing here is an internal squabble between the court system and the government. Certainly the Placer, Crystallex fight is being fought on those lines and it has simply been escalated to include GLR as well, probably to force a resolution. I think that the government needs the mine and they would have a very hard time regaining the confidence of any mining company in the future if this court action is ratified..
