Apple could go for the massive financial payday in an attempt to cripple HTC as a company, or it could negotiate a deal in which HTC gets to survive so long as it no longer manufactures Android phones. Such a move would immediately gash Android presence in the marketplace just as Apple is lighting up the iPhone 5 and current Android users on various carriers are about to make a decision whether to stay where they’re at or take the iPhone 5 leap. If Android phones are disappearing from shelves, either through settlement or by virtue of HTC’s looming financial troubles (and for that matter the possible upcoming financial troubles of Samsung as well), that decision becomes a bit easier. After all, the easiest way to motivate on-the-fence folks to change platforms is for their current platform to begin crumbling from within. Google, for its part, can always find other companies to manufacture Android phones or even begin selling more Google-branded smartphones itself (although its own Nexus One and Nexus S products have been among the worst selling Android phones to date). But now that Apple is armed with the legal power to essentially destroy any of various copycatting hardware manufacturers it wants, vendors may be in no mood to become the next to get sued by virtue of partnering with Google.
