This was the big issue which faced the framers of our Constitution, State rights vs Federal rights! The commerce clause greatly expanded the jurisdiction of the Federal Government. And, if I recall correctly, at this time has been supported by the Courts and past practice.

The great thing about the US Constitution is that you don't need a law degree to understand it. Really what is required is a basic understanding of the English language. Only a lawyer could contort the meaning of this great document to vastly expand the federal government's role in our lives. The commerce clause was put there to ensure smooth commerce between states and foreign entities (including indian nations). It's now being used as a land grab tool by power hungry politicians. The way the commerce clause is being used now is a total bastardization of the original intent.

The last person I want giving input on the US Constitution is a lawyer. Especially a progressive lawyer.
