Yes.. the litigation issue IS huge.. but courts are often slow and the issue is complex and full of legal nuance.

The question is whether BAC and the other banks can grow their way out of these legal liabilities over the course of the 5-10 years it will take to resolve them?

The sad thing about all of this is that the mortgage insurers were just left dangling in the wind. These lies and violations of "representations and warranties" have sent companies like ABK into run-off and no longer issuing new business.

Without financial surety, it's hard to generate more risk-taking by borrowers, or banks.
