NYSE:RKT VALIDATED JBII'S PROCESS AS VIABLE--PROOF!

(1) From the NYSE: RKT approved PR:

"We are honored that RockTenn has chosen JBI to be its long-term partner in this venture and believe this provides further validation that we have a viable commercial process to handle not only the critical issue of waste by-product but also rising energy costs.."

(2) Proof that NYSE: RKT had to approve the words "viable commercial process"

"The Parties shall jointly plan and co-ordinate any public notices, press releases, and any other publicity concerning the transactions contemplated by this Agreement and no Party shall act in this regard without the prior approval of the other..."

(4) Conclusion:

SO, we know from the contract that any press releases put out by JBII about the NYSE: RKT agreement, has to receive "prior approval" from NYSE: RKT. In the NYSE: RKT press release, JBII says RockTenn choosing JBII as a partner is validation that it is a "viable commercial process" -- therefore as part of NYSE: RKT's "months of comprehensive DD" they apparently made sure the process is indeed a "viable commercial process" before agreeing to that wording in JBII's press release.
