The thing with DC is interesting.

Congress decided to allow mmj in DC by non action. How the courts will view that will be telling.

Non action:
Washington DC passed a mmj law several years ago.
Congress stepped in and put an amendment on the budget bill that forbid the law to be implemented.
This amendment was attached for the next several years.
Then congress decided to stop forbidding mmj in DC. That decision was by vote of congress.

Congress may legally over ride the DEA.

Questions:

is this binding on the DEA? Are they now forbidden to enforce the CSA in DC with regard to marijuana?

The DEA claims to not be able to determine is it is medical or non medical marijuana. So does that kick the DEA out of the marijuana enforcement business entirely?

I believe that the DEA has sent out warning letters to officials in DC already, as they get ready to open their dispensaries.

This is a very interesting situation. And could produce major change.
