I agree with this, in principle.

But people do a lot of dumb things unwittingly, and there is always someone willing to exploit them.

Slum landlords are subject to housing laws.

Quacks are subject to prosecution for selling bad drugs or practicing medicine without a license.

Food sellers have always been prohibited from selling adulterated products. We have labeling laws and health inspections and USDA regulations.

Car makers are not allowed to sell dangerous vehicles, and we all have to have our cars inspected for safety every year.

So I don't see why financial institutions should expect to get away with egregious acts.

No matter how libertarian you may be, in principle, nobody has the right to commit fraud.
