grusum9, I will make one last try. The last thing an organizer wants is going to court unless it is the last resort - it weakens the solidarity of the masses due to the length of time it takes to go through the process. The key is winning the issue(s) whether the laws are broken or not.

In some contracts for organizers, they are paid even if they go to jail. Naturally, throwing 4,000 or more in jail over whelms the legal system - judges hate it especially if the judges are elected. If they make the wrong move the masses focus on the ouster of the judge through the political process. I know of situations where the masses totally disobeyed the judges injunction and dared the Judge to put the masses in jail since he was up for re-election. Some community populations are 80 - 90% organized. If all the organizations in the community are solidified as one: firefighter, police, UMW, Labor, public employees, teamsters, etc. the only individuals who can object are the money power brokers of the community. You can calculate who will win in that situation-the organizations.

Organizers hire attorneys to do what the organizers want them to do. The attorneys do not run the disputes, the organizer run the show, again staying within the realm of experience of the people.

We must remember, the lawyers may have the strongest (union) organization in the US. They control who enters the field by certifying who get to practice law through the bar examination, a large part of our legislators are lawyers who make the laws, most generally the judges are lawyers, and the lawyers practice in court in front of a lawyer. Hell, I wish we all had those conditions to make the laws, argue the law and practice the law in front of a lawyer. (Naturally Kenneth, probably will take issue with the fore mentioned statement.) :)

No, I am not any more intelligent than you. Only, I have had a different set of experiences which has guided me how to treat employee fairly. The autocrats/dictators sometimes have to be put in their place.
