Maybe this is similar to Buffett's investment limit in AXP (?). He said something that he can't continue buying it, because of some law but he does not have to sell it if his ownership percentage increases due to stock buybacks or similar. Maybe it's the same with FAIRX and BAC - he cannot buy more than 5%, but he is not forced to sell if the percentage climbs above 5% due to asset shrinkage.

However, if this is the case, then the problem is that he cannot buy more as the stock drops (50% down since his $12.25 full position price...).
