No, I'm not saying that, I am saying "the girl" shook the hell out of that child and most likely slammed his head against a hard surface causing a 2" skull fracture. The baby died, she caused his death, I do not give a damn what her motives were. I think the concept of "degrees" of murder are bogus, is the child any less dead because she just wanted to shut him up? I believe the first verdict was correct, she engaged in an overt act that was directly responsible for the death of another human being, when you start letting people plead ignorance regarding the outcome of their behaviour this is what you get. I would have added aggravated assault to the charge. The idea that this fat ass child killer is walking the streets free absolutely incenses me.
