I saw this topic discussed about the manslaughter vs. 2nd degree. Jerry Spence, I think. Oddly it seems that a conviction for murder with intent absolves the A. F. Au Pair, as they presumably are not responsible for malicious intent. Where as the more involuntary aspect of a manslaughter conviction places greater responsibility on the agency, not for poor screening of their applicants, but for inadequate trainging.

It would seem that there is an apparent conflict of interest on the part of the defense decisions.

I find it hard to be judgemental about this case, as I wasn't present for the case and didn't hear all the evidence. It seems that the judge has this discretion and he did hear the whole case. There was an aggressive prosecutor trying to make a name for himself by beating Barry Scheck, there was Barry Scheck amplifying his own fame. There was the au pair agency with itsown agenda. And there was the family crying for justice on TV. Altogether a highly charged atmosphere. This judge is no pushover liberal. That's our system and somewhere in all of this, there was someone who took responsibility to strike a balance, to do what he thought was right, based on what he does for a living. (No, I am not a relatinve of the judge, or even a lawyer, though I live in the Boston area.) I just think to let it be.

Now if we could try Saddam Hussein, there would be something I think everyone could agree on.
