Well, I don't think anyone including Amphastar was expecting the FDA approval in Sep so Sanofi's timing of launching its AG is another surprise. My view on this timing is similar to Peter's ( siliconinvestor.com ): that they were preparing for a launch since Sep and probably got a legal opinion from their patent lawyers on the odds for PI that favored a quick launch. On the implication on possible injunction, I agree with ij ( siliconinvestor.com ): that MNTA's irreparable harm argument has been damaged by the launch of AG. I don't know what Sanofi will do if MNTA gets its PI, perhaps play with pricing?
