I don't know about water, but in my town the city owns the strip between the sidewalk and the street. I'm supposed to get a permit to plant a tree there (confession: I planted two dogwoods there and did to pull a permit). Any trees in the strip belong to the city. YET if a tree needs pruning or removal, I am required to pay for said work.
