I would share your concern if the Democrats had a filibuster proof (or close to one) in the Senate but given that the Republicans may well end up winning the Senate in 2012, Obama's ability to appoint unacceptable candidates to the SCOTUS is not a factor.

Even if the Democrats maintain a majority in the Senate, the Republicans can and will filibuster an unacceptable replacement to the SCOTUS.

I would be much more concerned with Gingrich's nominations because he is erratic and, IMO, a progressive at heart. It is much less likely that the Republicans would try and block a nomination by a Republican president.
