The was senator Frist that made poker illegal. He did it on his way out and it was pay back to Harrahs.

What Brunson is doing, is jabbing around, picking up small pots, but always with outs. Then when someone gets him, all they win back is the money he stole from them in the first place, and as he says, sometimes he hits those outs (why people think he is lucky); and sometimes he has a hand.
