There was no trespass as at the time of staking, those lands were in the public domain, safety violations perhaps but that not gonna hold water as far as title goes. Another sidelight here is those claims CDE held were leased from another party,which according to all standard procedures, requires CDE to keep them in good standing. CDE best cut their losses expediently or they will have another lawsuit on their hands.
