Put it this way

You had gains of $100k in 2009 and you paid 20k in tax if you were in a 40% tax level
You have no gains this year but you can still sell losers up to $100k and get the tax back that you paid in 2009.
Your sale of a loser in the future can only be applied against a gain unless you are a trader and earning income by trading
