Chapter 13 is a personal form of bancruptcy, I believe, and requires income. Hardly any chance of that here. Nuko would have to file a Chapter 11 to have its debt reorganized or a Chapter 7 liquidation. They could still screw the common shareholders by issuing preferred stock before a buyout which could then be redeemed for n:1 common shares.
