OK---your summation of the discussion is more or less accurate. And I am glad we had it as it made me realize there are other aspects of the case I hadn't thought about at first glance.

I do agree that the political equation may prevent an actual suit being from being filed. It is possible also that Republican counselors, after further research, may have concluded it might not be a slam dunk for them and thus more strength would accrue to the Executive branch. And then there's the whole obstructionist argument with that baggage they may not want to be seen carrying.

I myself am hoping that some entity does file (reportedly the US Chamber of Commerce was going to take it up, but I see a standing issue there for them to overcome) as I think it raises important issues over the separation of powers that need to be resolved. But as you pointed out this may not be the best time for such battle for the Republicans.
