You don't have to imagine one. The Constitution grants the power to make such appointments to the President, and in fact requires him to make them.

The fact that the Senate is using a stupid human trick to subvert the will of the Founders and of the American people doesn't mean Obama gets to ignore his Constitutionally mandated duties. The Senates actions in this case aren't about checks and balances. They're about obstruction, pure and simple.
