For me the "excess" was just a matter of putting" some context around the issue, and to be even handed I believe he faults the Bush Administration for the same practice of ruling by regulation. McConnell, or anyone else with that view point won't get to your substantive points because he clearly believes, IMHO, one unconstitutional move doesn't justify another one--viewed through his legal prism of course.
