And McConnell's argument is that this is the constitutional right of the legislative body to proceed in such a manner (for the reasons he gave in the article). Anyway here's Professor Bruce Ackerman of Yale University faulting Obama for: 1: Not using the DOJ for his legal opinion/reliance in making the appointments (its an Arms length agency supposedly independent instead of WH counsel) and; 2. Not releasing the WH's counsel's legal opinion on which Obama based his appointment actions. Essentially ruling by fiat. online.wsj.com
