So WHAT?

Federal bankruptcy law has LONG superseded such contracts.

So there is no 'usurping' about it, it clearly (and since at least World War II) has been legally superior.

That is the WHOLE PURPOSE of federal bankruptcy in the US... to allow for the shedding of cost overhangs so that through reorganization a viable and ongoing business can emerge.
