Bob, many investors actually buy into Datek's statement that they are not responsible when their system fails and you can't get through to them by phone or e-mail. If that is the case with anyone, you have a very good chance of winning in arbitration.

There are other situations that Datek is responsible for as well, such as if you make a trade based on wrong information your broker gave you. This is a basic violation. Some have made a trade which they received confirmation for (by the Daily activity page and/or e-mail confirm), and then traded the security again. Only to find out well afterwards that the initial trade really didn't occur. In cases like this, the Broker is held responsible.
