Dear Judge Irizarry:

The government writes in response to the questions raised by Your Honor at the last status conference on this matter on February 8, 2012.

The United States Attorney’s Office for the Eastern District of New York (the “Office”) opened its investigation intoSpongetech in March 2010. The law enforcement agencies that are working in conjunction with the Office on this case, the Internal Revenue Service and the Federal Bureau of Investigation, began preliminarily investigating Spongetech as early as November 2009.

With respect to the Court’s second question, Metter testified on October 13, 2009 in Washington, D.C. He gave testimony pursuant to an investigative subpoena issued by the staff of the Enforcement Division of the Securities and Exchange Commission (“SEC”). As the SEC staff members who were conducting the investigation were based in Washington, D.C., the testimony occurred there rather than in New York.
