If a mobile device mfg wants to limit litigation…. Use a QCOM chipset , and don’t be first to litigate. ….Patent Peace.

Well that sort of depends. Most of the industry is involved in litigation with Apple. Perhaps Q has pass-through rights to Apple's FRAND patents, but that wont protect companies from Apple's OS and touch patents.


Yes, “limits” but not entirely avoids litigation. From my understanding the avoidance is limited to-

…… + Essential IPR developed by QCOM’s licensees who signed onto the third party provision, and

…….+ may or may *not* include their non-essential IPR. And, I believe we’ve been told a great number of licensee’s (especially the lower volume mfgs) have accepted that provision.

Re: Apple, I don’t believe it’s been disclosed if they agreed to the 3rd party pass-thru provision but my guess is that Apple has ***not**. Thus IMO I don’t believe a Q licensed handset mfg’s devices enabled by QCOM chip automatically have access to Apple’s essential IPR.

There remain many areas over which to litigate, but QCOM’s business model employing 3rd party IPR pass-thru rights is a step in the right direction in lowering costs associated with IPR / licensing and promoting patent peace.
