A few things to consider.

In a Workers Compensation case, liability is not an issue the worker is entitled to collect regardless of fault, even if it is the Workers fault, with certain very limited exceptions that vary from state to state.

If you are suggesting that we compensate every patient for a bad outcome, it could end up being more expensive than the current system.

Where does the money come from. i.e. who pays the costs and expenses. Do the doctors bear the cost? Does the State bear the cost? Does the patient, maybe by an add on premium to cover the cost of insurance?

Don't know unless we try it and see. Another idea to try on an individual State basis to see if it really works.d

There is a reason why this problem has persisted for such a long time.
