The existence of these interpretations, which are contained in classified opinions issued by the Foreign Intelligence Surveillance Court, has been acknowledged on multiple occasions by the Justice Department and other executive branch officials.”

My guess is that FISA has determined that Congress's AUF grants the President the full extent of his war powers, including the power to collect intelligence within the United States on suspected foreign agents.

The difficulty is determining whether the DOJ under Eric Holder is abusing that power.
