Kennedy at one point said that allowing the government mandate would "change the relationship" between the government and its citizens.


"Do you not have a heavy burden of justification to show authority under the Constitution" for the individual mandate? asked Kennedy, who is often the swing vote on cases that divide the justices along ideological lines.

Very encouraging questions coming from Kennedy. Shows he's thinking about a limiting principle, noticeably absent from the individual mandate.

Rush is surprised at the surprise and distress being displayed on CNN. Apparently it has just struck them for the first time that the mandate could be struck down, and perhaps the whole bill with it. Rush is astonished that the possibility had not penetrated their worldview before this.
