The left is far more guilty of that. You claim that the commerce clause justification of Obamacare is settled law. The case that justifies it, Wickard, was one of the most preposterous rulings ever, made by a court full of FDR appointed leftists. I suppose that wasn't partisan ideology? The mandate goes far beyond anything ruled on before, if it was settled law, the court wouldn't being hearing it.
