I would say you're right. He found the magic catalyst and then pyrolyzed the tape. Now the catalyst exists inside his own mind and nobody can prove he doesn't have a magical catalyst recipe etched in his brain. Just like Mr. RIvera of USSE. Mr. Rivera even said it was based on 'nanotechnology'. Who could disprove that?? Sure it seems unlikely since half the time his lab was in the back of his truck but that doesn't make it impossible. Mr. RIvera obviously felt that since nobody could unlock what was inside his head that nobody could disprove it and therefore it would be impossible to win in litigation. He was wrong.

That said, I think the SEC's focus on the accounting with Mr. Bordynuik was a great angle. First they named Mr. Bordynuik and not JBI to prevent him from playing shell games. Second, they got concrete evidence which shows any shareholders who care to listen that Mr. Bordynuik is an egregiously dishonest man. Smarter, more experienced investors will understand that a penny stock where complete control is maintained by a dishonest man isn't a glowing endorsement for that investment no matter how high the promised riches.
