Hi Brian,

Unfortunately, the actual publication date of the new Regs is uncertain, albeit close.

Remember, we are dealing with the Federal Government here, and the Christmas Holiday is barely a few weeks away.

My best *guess* is that they will be published some time in January. After all, NHTSA went to considerable effort to indicate it wanted to get this new technology out into the real world when it posted in an earlier Federal Register:

"The agency is proposing that the final rule become effective 30 days after it is published. NHTSA is proposing that the final rule's effective date be less than 180 days after publication in an effort to facilitate the early introduction of dynamic systems that may be in an advanced stage of development or actually in production. As production of vehicles with dynamic systems may begin prior to the effective date of the final rule, NHTSA will allow manufacturers of such vehicles to include them in their calculation of complying vehicles under 86.1.5 if such vehicles meet the requirements of S6.1(b) or S6.1(c) as promulgated in the final rule."

In short, NHTSA wants to hurry ITS into production, and has cut short the time necessary to reach the "effective date" in order to help that process along.

Have a good evening, Brian.
