Martial Law is illegal if the civilian courts are still capable of functioning. That's why the Mayor of New Orleans declaring martial law during Katrina was illegal. You can set curfews and have the streets patrolled by National Guard, but you cannot hand over civilians to military courts and tribunals while civilian courts are still functioning. Maybe the excuse will be, hey we just rounded up 10M citizens and the civilians courts are overwhelmed...
